Thank you for choosing noe ai, your personal skin-health tracker and analyzer. This policy explains how we handle information whenever you use the app.
1. Acceptance of These Terms
By downloading, installing, or using Noe AI (“App”), you agree to be bound by these Terms of Service (“Terms”) and Apple’s Standard Licensed Application End User License Agreement (EULA). If you do not agree, do not use the App.
2. Who May Use Noe AI
- Age. You must be 13 years or older. If you are under 18, you represent that a parent or legal guardian also accepts these Terms.
- Location. Noe AI is offered worldwide, but some features such as subscriptions may not be available in every jurisdiction.
3. Subscriptions & Billing
- Optional Subscription. Noe AI offers an optional auto-renewing subscription via Apple In-App Purchase (“IAP”). All pricing, billing, trial length, renewal, and cancellation are handled by Apple.
- Cancellation. You may cancel at any time in your Apple ID settings; access to premium features remains until the current billing period ends.
- Refunds. Apple’s refund policy applies. Donna Mägi does not issue direct refunds.
4. User-Generated Content
Noe AI lets you upload photos and other content (“User Content”) for skin-analysis features.
- Limited-purpose license. When you upload a photo or other User Content, you give Noe AI permission—worldwide, royalty-free, and non-exclusive—to store, process, and display that content only as needed to analyze your skin and deliver the app’s features. Noe AI does not claim ownership of your photos and will never use them for advertising or any purpose beyond running the service.
- Retention. Photos are kept only as long as needed for analysis and related features, then deleted or anonymised.
- Your Responsibility. You must own the content you upload and have permission from anyone depicted. Do not upload unlawful, infringing, or obscene material.
5. Privacy
The collection, use, and deletion of personal data are described in the Noe AI Privacy Policy, available in-app and on donnamagi.com. These Terms incorporate that policy by reference.
6. Health & Medical Disclaimer
Noe AI provides informational content only. It is not medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any skin concern. Reliance on Noe AI is at your own risk.
7. Intellectual Property
The App, its code, design, text, graphics, trademarks, and all other intellectual property are owned by or licensed to Donna Mägi and are protected under applicable laws.
8. Prohibited Conduct
You agree not to:
- Reverse-engineer, decompile, or copy the App;
- Circumvent subscription or security features;
- Upload viruses or harmful code;
- Use the App to harass, defame, or violate any law.
9. Termination
Donna Mägi may suspend or terminate your access at any time for violation of these Terms. Upon termination, your license ends and you must delete the App; Sections 4–13 survive.
10. Third-Party Services
Noe AI may link to third-party sites or services. Donna Mägi is not responsible for their content, privacy practices, or accuracy.
11. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Your use is at your sole risk.
12. Limitation of Liability
To the maximum extent allowed by law, Donna Mägi will not be liable for indirect, incidental, consequential, or special damages, or for any amount exceeding the fees you paid, if any, in the 12 months before the claim.
13. Indemnification
You agree to indemnify and hold harmless Donna Mägi from any claim or demand arising out of your breach of these Terms or your misuse of the App.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles. Any dispute shall be brought in the courts of Tallinn, Estonia. You agree to submit to their personal jurisdiction.
15. Modifications to Terms
We may update these Terms at any time. Material changes will be notified in-app or via the email linked to your Apple ID if you have registered. Continued use after the effective date constitutes acceptance.
