Thank you for choosing noe ai, your personal skincare tracking and skin appearance insights app. These Terms of Service (“Terms”) govern your use of the application (“App”), which is provided by DM Investing OÜ (the “App provider”, “we”, “us”), a company registered in Estonia under register code 16063296, with its registered office at Kase 5, 12011 Tallinn, Estonia.
1. Acceptance of These Terms
By downloading, installing, or using the App, you agree to be bound by these Terms and Apple’s Standard Licensed Application End User License Agreement (EULA). If you do not agree, do not use the App.
2. Who May Use the App
- Age. You must be at least 13 years old to use the App. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms.
- Location. The App is offered worldwide, but certain features (including subscriptions) may not be available in all jurisdictions.
3. Subscriptions & Billing
- Optional Subscription. The App offers optional auto-renewing subscriptions via Apple In-App Purchase. All pricing, billing, trial periods, renewals, and cancellations are handled by Apple.
- Cancellation. You may cancel at any time in your Apple ID settings. Access continues until the end of the billing period.
- Refunds. Apple’s refund policy applies. The App provider does not issue direct refunds.
4. User-Generated Content
The App allows you to upload photos and other content (“User Content”) to generate skin appearance insights.
- License. By uploading User Content, you grant a limited, worldwide, non-exclusive, royalty-free license to store, process, and display such content solely as necessary to provide the App’s functionality.
- Ownership. You retain ownership of your content. The App does not use your content for advertising or unrelated purposes.
- Retention. Photos are kept only as long as necessary to provide the service, then deleted or anonymised.
- Responsibility. You must have the rights to any content you upload and must not upload unlawful, infringing, or harmful material.
5. Privacy
Data handling practices are described in the Privacy Policy, which is incorporated into these Terms by reference.
6. Non-Medical Use and Disclaimer
The App is designed for cosmetic and informational purposes only. It provides general skincare insights and routine suggestions based on user input and image-based observations of skin appearance.
The App does not provide medical advice, diagnosis, or treatment, and is not intended to identify, manage, or treat any medical condition.
You must not rely on the App as a substitute for professional medical advice. If you have any concerns about your skin or health, you should consult a qualified healthcare professional.
No use of the App creates a doctor–patient or healthcare provider–patient relationship.
Your use of the App and any reliance on its content is solely at your own risk.
7. Intellectual Property
All rights, title, and interest in and to the App—including its code, design, text, graphics, trademarks, and other content—are owned by or licensed to the App provider and are protected by applicable intellectual property laws.
8. Prohibited Conduct
You agree not to:
- Reverse-engineer, decompile, or copy the App.
- Circumvent subscription or security features.
- Upload malicious or harmful content.
- Use the App in violation of applicable laws or regulations.
9. Termination
Access to the App may be suspended or terminated at any time for violation of these Terms. Upon termination, your right to use the App ends immediately.
10. Third-Party Services
The App may include links to third-party websites or services. The App provider is not responsible for their content, accuracy, or privacy practices.
11. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
The App does not guarantee any specific results or improvements in skin appearance.
12. Limitation of Liability
To the maximum extent permitted by law, the App provider shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the App.
This includes, without limitation, any decisions made or actions taken based on information provided by the App.
Total liability shall not exceed the amount paid by you, if any, for use of the App in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless the App provider from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or misuse of the service.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of Estonia. Any disputes shall be resolved exclusively in the courts of Tallinn, Estonia.
15. Modifications to Terms
These Terms may be updated from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
